NextGen UBE Test Day Policies

Introduction 

The NextGen Uniform Bar Examination (NextGen UBE) is a standardized, high-stakes licensure exam developed and owned by the National Conference of Bar Examiners (NCBE). It is administered by participating jurisdictions as part of the bar admissions process. This document outlines the official Test Day Policies that all candidates must follow to sit for the NextGen UBE. 

These policies are designed to ensure a fair, secure, valid and consistent testing experience for all examinees. By sitting for the exam, you reconfirm your agreement to comply with the terms and conditions of the NextGen UBE Candidate Agreement and with all policies outlined in this document, as well as any additional rules communicated by your jurisdiction or testing site. 

Requirements and Policies

Eligibility and Pre-Exam Requirements 

To be eligible to take the NextGen UBE, you must 

  • be authorized by a participating jurisdiction; 
  • have a valid NCBE Account and NCBE Number; and
  • complete all required pre-exam steps through your NCBE Account, including 
    • agreeing to the NextGen UBE Candidate Agreement; 
    • payment of the required technology fee; 
    • downloading and installing the NCBE Secure Browser; and
    • completing the exam tutorial and sample questions using the NCBE secure browser. 

If you do not complete these steps at least 72 hours before the exam, you will not be permitted to test. 

Exam Day Admission Requirements 

To be admitted to the testing room, you must 

  • arrive at least 90 minutes before the scheduled exam start time; 
  • bring the same laptop you used to download and install the NCBE Secure Browser and complete the exam tutorial; 
  • have the NCBE Secure Browser installed and functioning; 
  • bring a working laptop charger and keep your device plugged in throughout testing; 
  • present a valid, government-issued photo ID with a name that matches the name in your NCBE Account and your registration with your jurisdiction; and 
  • know or have access to your NCBE Number. 

Failure to meet any of these requirements may result in denial of entry or cancellation of your attempt. 

Permitted and Prohibited Items 

Permitted items you may bring to your testing seat include only: 

  • Your laptop and charger 
  • Government-issued photo ID 
  • Mouse (wired only)

Prohibited items include: 

  • Any internet or Bluetooth-connected devices 
  • Phones, smartwatches, fitness trackers (including Oura rings), smart glasses, headphones or earbuds 
  • Earplugs (unless provided by your jurisdiction)
  • Electronic devices, cameras, recording devices or photographic equipment of any kind
  • Notes, books, papers, study materials, test-taking aids or printed reference materials 
  • Bags not authorized by the jurisdiction 

Possession of a prohibited item may result in immediate dismissal and cancellation of your exam. 

Secure Testing Procedures 

  • You must complete each of the three exam sections on the scheduled days. 
  • You may navigate freely within each section but cannot return to prior sections once a section ends. 
  • Each section must be taken on the scheduled day and time; late starts are not permitted. 
  • You must remain seated unless granted permission to leave (e.g., for restroom breaks). 
  • All activities are monitored by proctors and may be subject to video surveillance. 

Technology Use and Technical Issues 

  • You must use the same laptop that passed the system check and that you used to complete the exam tutorial. 
  • Your device must remain plugged in throughout the exam. 
  • If you experience technical issues, notify a proctor immediately. Certified Technical Proctors are on-site to assist. 
  • In rare cases, a backup laptop may be issued if the issue is due to secure browser malfunction, but not if your device wasn’t properly prepared or lacks a charger. 
  • You must remain on-site until your exam responses have been successfully submitted. 

Prohibited Conduct 

You may not engage in any of the following: 

  • registering for or attempting to take the NextGen UBE more than once during the same test administration; 
  • falsifying your identity or impersonating another exam candidate (proxy or surrogate testing);
  • gaining unauthorized advance access to exam content; 
  • talking to or communicating with anyone about live NextGen UBE exam content, in whole or part;
  • giving, receiving, or soliciting (including by viewing of exam content) unauthorized assistance on the NextGen UBE; 
  • bringing, accessing, or using unauthorized or prohibited items during the exam 
  • causing disruptions or disturbances during the exam (e.g., making noise or behaving disruptively); or 
  • copying, capturing, recording, collecting, reconstructing, memorizing, discussing, disclosing, soliciting, transmitting, broadcasting, streaming, reproducing, or distributing NCBE examination content, in whole or part, including any exam question, fact patterns, answer choices, or answers, through any method or medium (oral, written, electronic, or otherwise), or facilitating such actions by others. 

Violations may result in score cancellation, referral to bar authorities, civil or criminal liability, and notation of your attempt on your UBE transcript. 

Reporting Test Day Violations 

If you observe any behavior during the exam that may violate these policies or compromise the fairness, security, or integrity of the testing environment, you must report it immediately.

  • Notify a proctor in the testing room as soon as possible.
  • If you cannot report the issue during the exam for any reason, report it promptly after the exam using the Contact form on the NCBE website (select Test Security Violation Report from the Topic menu).
  • Reports should include as much detail as possible, including the nature of the behavior, timing, and any individuals involved.

After the Exam 

Before leaving the testing room: 

  • A proctor must verify that your exam data has been successfully submitted. 
  • If connectivity is lost, you must remain on-site while a Certified Technical Proctor facilitates the submission. 
  • Jurisdiction-issued materials must be returned and will be securely destroyed. 

Score Reporting and Use 

  • Your performance will be scored according to NCBE’s standardized procedures. 
  • Only examinees who attempt all three sections will receive an official NextGen UBE score. 
  • Your official score will be released to the jurisdiction that authorized you to test. 
  • You may request that NCBE transfer your score to other jurisdictions using your NCBE Account. 

Agreement to Policies 

By sitting for the NextGen UBE, you agree to abide by these Test Day Policies, the Candidate Agreement, and all related policies and procedures provided by NCBE and your jurisdiction. Failure to do so may result in denial of testing, cancellation of your score, or other penalties.


All NCBE exam products must be administered in the presence of an in-person proctor. For the MEE, MPT, MBE, UBE, and NextGen UBE, the proctor must be provided by the jurisdiction.

NCBE strictly prohibits copying, reproducing, or disclosing any NextGen UBE questions or answers, whether via electronic, telephonic, written, oral, or other means, to any party or to any public forum during or after the exam. NCBE will use every legal means available to protect its copyrighted materials. Any unauthorized disclosure of NextGen UBE content could result in civil liability, criminal penalties, cancellation of test scores, denial of applications to sit for future exams, denial of bar applications on character and fitness grounds, and/or disciplinary action by bar authorities.
